根據《城(cheng)市(shi)規(gui)劃(hua)法》,我國現行的(de)城(cheng)市(shi)規(gui)劃(hua)管理(li)程序(xu)是按照“建設項(xiang)目選址意見(jian)書(shu)”、“建設用地規(gui)劃(hua)許(xu)可(ke)證(zheng)”、“建設工(gong)程規(gui)劃(hua)許(xu)可(ke)證(zheng)”程序(xu)進行的(de)。如果在城(cheng)市(shi)規(gui)劃(hua)管理(li)中引入交(jiao)通影響評(ping)價制度,必然涉(she)及到交(jiao)通影響評(ping)價與“一書(shu)兩證(zheng)”的(de)銜(xian)接問題(ti)。
《道路交(jiao)(jiao)(jiao)通(tong)(tong)安全(quan)法實(shi)施條例》僅(jin)僅(jin)規(gui)定“縣級以上地(di)方(fang)各級人民政府應(ying)當……組織有關部(bu)門對城市(shi)建設(she)(she)項目進(jin)(jin)(jin)行交(jiao)(jiao)(jiao)通(tong)(tong)影(ying)響(xiang)(xiang)(xiang)評(ping)價(jia)(jia)”,而并沒有明確(que)交(jiao)(jiao)(jiao)通(tong)(tong)影(ying)響(xiang)(xiang)(xiang)評(ping)價(jia)(jia)的(de)實(shi)施階(jie)段。根據實(shi)際情況,目前國內開展了交(jiao)(jiao)(jiao)通(tong)(tong)影(ying)響(xiang)(xiang)(xiang)評(ping)價(jia)(jia)的(de)城市(shi)一般是在規(gui)劃設(she)(she)計(ji)方(fang)案審查階(jie)段,即在取(qu)得《建設(she)(she)用地(di)規(gui)劃許可證(zheng)》之后未取(qu)得《建設(she)(she)工(gong)程規(gui)劃許可證(zheng)》期(qi)間,主管部(bu)門認為需要,才進(jin)(jin)(jin)行此項工(gong)作。如(ru)《北京市(shi)規(gui)劃委員會關于(yu)對部(bu)分新建項目進(jin)(jin)(jin)行交(jiao)(jiao)(jiao)通(tong)(tong)影(ying)響(xiang)(xiang)(xiang)評(ping)價(jia)(jia)的(de)通(tong)(tong)知》規(gui)定“交(jiao)(jiao)(jiao)通(tong)(tong)影(ying)響(xiang)(xiang)(xiang)評(ping)價(jia)(jia)應(ying)按規(gui)劃行政主管部(bu)門核(he)發的(de)《規(gui)劃意見書》要求與設(she)(she)計(ji)方(fang)案同步進(jin)(jin)(jin)行,交(jiao)(jiao)(jiao)通(tong)(tong)影(ying)響(xiang)(xiang)(xiang)評(ping)價(jia)(jia)報(bao)告作為附件(jian)與建設(she)(she)項目設(she)(she)計(ji)方(fang)案同時(shi)報(bao)審”。
本文(wen)認為,從技術(shu)上(shang)講,在(zai)(zai)取得《建設用地規(gui)(gui)劃(hua)(hua)(hua)許(xu)可(ke)(ke)(ke)(ke)證》之后未取得《建設工程規(gui)(gui)劃(hua)(hua)(hua)許(xu)可(ke)(ke)(ke)(ke)證》期(qi)間,建設項(xiang)目的(de)(de)(de)(de)規(gui)(gui)劃(hua)(hua)(hua)設計方案已經完成,為交通(tong)影響分(fen)析提供(gong)了較好的(de)(de)(de)(de)基(ji)礎(chu),分(fen)析也(ye)能夠達到一定(ding)(ding)的(de)(de)(de)(de)深度;但(dan)是(shi),如果在(zai)(zai)該階段開始進(jin)行(xing)(xing)交通(tong)影響評(ping)價,其弊端也(ye)是(shi)顯而(er)易(yi)見的(de)(de)(de)(de)。根據(ju)《行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)許(xu)可(ke)(ke)(ke)(ke)法》的(de)(de)(de)(de)信(xin)賴保護原則,規(gui)(gui)劃(hua)(hua)(hua)設計要(yao)(yao)(yao)點一旦由規(gui)(gui)劃(hua)(hua)(hua)部(bu)門(men)(men)提供(gong),就應(ying)當被推(tui)定(ding)(ding)為合法有(you)效。法律要(yao)(yao)(yao)求(qiu)相(xiang)(xiang)對(dui)人(ren)對(dui)此予(yu)以(yi)信(xin)任(ren)和依(yi)賴,相(xiang)(xiang)對(dui)人(ren)基(ji)于對(dui)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)許(xu)可(ke)(ke)(ke)(ke)的(de)(de)(de)(de)信(xin)任(ren)和依(yi)賴并因此而(er)進(jin)行(xing)(xing)的(de)(de)(de)(de)相(xiang)(xiang)關(guan)工作與投資,也(ye)應(ying)當受到法律保護。禁(jin)止規(gui)(gui)劃(hua)(hua)(hua)部(bu)門(men)(men)以(yi)任(ren)何借口擅自改(gai)變既有(you)的(de)(de)(de)(de)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)許(xu)可(ke)(ke)(ke)(ke)甚至反(fan)復(fu)無常,即便是(shi)自我糾正錯誤(wu)也(ye)要(yao)(yao)(yao)受到一定(ding)(ding)的(de)(de)(de)(de)限制。因此,《行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)許(xu)可(ke)(ke)(ke)(ke)法》第八條規(gui)(gui)定(ding)(ding)“公(gong)(gong)民、法人(ren)或(huo)(huo)者其他組織依(yi)法取得的(de)(de)(de)(de)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)許(xu)可(ke)(ke)(ke)(ke)受法律保護,行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)機關(guan)不得擅自改(gai)變已經生(sheng)(sheng)效的(de)(de)(de)(de)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)許(xu)可(ke)(ke)(ke)(ke)。行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)許(xu)可(ke)(ke)(ke)(ke)所(suo)依(yi)據(ju)的(de)(de)(de)(de)法律、法規(gui)(gui)、規(gui)(gui)章(zhang)修改(gai)或(huo)(huo)者廢止,或(huo)(huo)者準予(yu)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)許(xu)可(ke)(ke)(ke)(ke)所(suo)依(yi)據(ju)的(de)(de)(de)(de)客觀(guan)情況發生(sheng)(sheng)重大變化的(de)(de)(de)(de),為了公(gong)(gong)共利(li)益的(de)(de)(de)(de)需要(yao)(yao)(yao),行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)機關(guan)可(ke)(ke)(ke)(ke)以(yi)依(yi)法變更或(huo)(huo)者撤回已經生(sheng)(sheng)效的(de)(de)(de)(de)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)許(xu)可(ke)(ke)(ke)(ke)。由此給公(gong)(gong)民、法人(ren)或(huo)(huo)者其他組織造成財產損失的(de)(de)(de)(de),行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)機關(guan)應(ying)當依(yi)法給予(yu)補(bu)償。”
因(yin)此,在(zai)取得《建設(she)用地(di)規劃(hua)許(xu)可(ke)(ke)證》之(zhi)后(hou)、未取得《建設(she)工程規劃(hua)許(xu)可(ke)(ke)證》期間,進行交通(tong)影響分析往往只(zhi)能(neng)(neng)對建設(she)項目提(ti)出(chu)一(yi)些(xie)改進措施,較難提(ti)出(chu)控制開發強(qiang)度(du)的(de)(de)要(yao)(yao)求(qiu)。因(yin)為主管部(bu)(bu)門在(zai)批出(chu)《建設(she)用地(di)規劃(hua)許(xu)可(ke)(ke)證》階段已提(ti)供了(le)規劃(hua)設(she)計(ji)要(yao)(yao)點(dian),確定了(le)開發強(qiang)度(du)指標(biao)。一(yi)旦(dan)建設(she)項目的(de)(de)交通(tong)影響評價不能(neng)(neng)通(tong)過(guo),或必(bi)須采(cai)取改進措施,根據信賴保護(hu)原則,在(zai)法(fa)律上將(jiang)形成對規劃(hua)部(bu)(bu)門極為不利的(de)(de)局面(mian)。交通(tong)影響評價沒有通(tong)過(guo)而被規劃(hua)部(bu)(bu)門否決存在(zai)法(fa)律上的(de)(de)障礙,因(yin)此,實際的(de)(de)操作結果,必(bi)將(jiang)會出(chu)現“交通(tong)影響評價流于(yu)形式的(de)(de)局面(mian)”;否則,在(zai)相對人看(kan)來(lai),就是政府(fu)鄭(zheng)重的(de)(de)承諾——規劃(hua)設(she)計(ji)要(yao)(yao)點(dian),可(ke)(ke)以改變,嚴肅的(de)(de)法(fa)律成為笑談(tan),其結果是降低了(le)規劃(hua)部(bu)(bu)門的(de)(de)公信力,背離(li)了(le)城市規劃(hua)管理的(de)(de)目標(biao),損害(hai)了(le)規劃(hua)部(bu)(bu)門的(de)(de)形象(xiang)和權威。它所帶來(lai)的(de)(de)將(jiang)不僅(jin)僅(jin)是經濟損失,而且是對城市規劃(hua)的(de)(de)信任危機。
基于(yu)(yu)以上法律上的(de)瑕疵,本文(wen)認為,可以借鑒《環(huan)境影(ying)(ying)響(xiang)評(ping)價法》的(de)立法意圖,對交通(tong)影(ying)(ying)響(xiang)評(ping)價與(yu)“一書兩證”的(de)銜(xian)接進行(xing)合理劃(hua)分(fen)。可以考慮把把交通(tong)影(ying)(ying)響(xiang)分(fen)析工作提(ti)前,對于(yu)(yu)需要選(xuan)址的(de)項目(mu),可以放在《建設項目(mu)選(xuan)址意見書》批核發(fa)之前;對于(yu)(yu)不需要選(xuan)址的(de)項目(mu),可以放在“建設用地規劃(hua)許(xu)可證”階(jie)段(duan)。此時,規劃(hua)部門比較容易(yi)進行(xing)開(kai)發(fa)強(qiang)度控制,以及有效防止選(xuan)址不當對城市交通(tong)造成(cheng)的(de)危害。
事實上(shang),在此(ci)階段進行交通影響評價實質(zhi)上(shang)就是選址(zhi)論證(zheng)的一(yi)個(ge)環(huan)節。如《上(shang)海市城市規(gui)劃條(tiao)(tiao)例》第五十六(liu)條(tiao)(tiao)第二款規(gui)定(ding)“建(jian)設單位(wei)或者個(ge)人申(shen)(shen)請(qing)建(jian)設項目選址(zhi)意見書,應當(dang)填報《建(jian)設項目選址(zhi)申(shen)(shen)請(qing)表》,并按照規(gui)定(ding)附送有(you)關文件、圖紙。大中型建(jian)設項目,應當(dang)事先委(wei)托有(you)相應資(zi)質(zhi)的規(gui)劃設計單位(wei)作出選址(zhi)論證(zheng)。”而此(ci)階段的交通影響評價就可以認為(wei)是選址(zhi)論證(zheng)的一(yi)個(ge)重要內容。
但是,由于在此階(jie)段(duan)(duan)建(jian)設(she)規劃(hua)方案還(huan)沒進行(xing),交(jiao)通(tong)影響分析(xi)的(de)深(shen)度不(bu)(bu)夠,較難對建(jian)設(she)項目內部交(jiao)通(tong)等進行(xing)評析(xi)。因此,可以與“一(yi)書(shu)兩證(zheng)”制(zhi)度保持一(yi)致,即根(gen)據建(jian)設(she)項目的(de)性質、報批階(jie)段(duan)(duan)的(de)不(bu)(bu)同,并(bing)考慮到交(jiao)通(tong)影響評價實質上就是局(ju)部的(de)交(jiao)通(tong)規劃(hua),將(jiang)交(jiao)通(tong)影響評價分成《建(jian)設(she)項目交(jiao)通(tong)影響分析(xi)意見書(shu)》和(he)《建(jian)設(she)項目影響評價報告(gao)書(shu)》兩個(ge)階(jie)段(duan)(duan)和(he)深(shen)度。
綜合以(yi)上分析,在《建設(she)(she)項目選址意(yi)見書》階段,規劃主管部門(men)認為對城市交通具有重大影(ying)響(xiang)(xiang)的(de)項目,應在提供規劃設(she)(she)計要點(招拍掛的(de)土地(di)出讓項目)、核發(fa)《建設(she)(she)項目選址意(yi)見書》或《建設(she)(she)用地(di)規劃許可證》之前編(bian)制《建設(she)(she)項目交通影(ying)響(xiang)(xiang)分析意(yi)見書》。
在“建設(she)工程(cheng)規劃(hua)(hua)許可證”階(jie)段,凡是編(bian)制(zhi)《建設(she)項目(mu)(mu)交通(tong)影(ying)響(xiang)分(fen)析意見書》的項目(mu)(mu),均應(ying)編(bian)制(zhi)《建設(she)項目(mu)(mu)交通(tong)影(ying)響(xiang)分(fen)析報告書》,但應(ying)注意避免與《意見書》重復。對于其它沒(mei)有編(bian)制(zhi)《意見書》,可根據實際情況,由規劃(hua)(hua)主管部門決(jue)定是否(fou)編(bian)制(zhi)《建設(she)項目(mu)(mu)交通(tong)影(ying)響(xiang)分(fen)析報告書》。
對于(yu)(yu)大項目施(shi)(shi)工(gong)(gong)期間交(jiao)通(tong)(tong)組織(zhi)(zhi)的(de)交(jiao)通(tong)(tong)影響評價問題,有的(de)地方也試圖(tu)(tu)將其納入城市規劃管(guan)(guan)(guan)理的(de)范疇。本文(wen)認(ren)為(wei),《建筑法》第(di)八(ba)條(tiao)規定(ding)“申請(qing)領取施(shi)(shi)工(gong)(gong)許可(ke)證,應(ying)當(dang)具備(bei)下列條(tiao)件:(五(wu))有滿足施(shi)(shi)工(gong)(gong)需(xu)要的(de)施(shi)(shi)工(gong)(gong)圖(tu)(tu)紙(zhi)及(ji)技術資(zi)(zi)料(liao);應(ying)該屬于(yu)(yu)在建設(she)(she)(she)單位施(shi)(shi)工(gong)(gong)許可(ke)證之前(qian)進行編制(zhi)”,而交(jiao)通(tong)(tong)組織(zhi)(zhi)設(she)(she)(she)計(ji)為(wei)施(shi)(shi)工(gong)(gong)圖(tu)(tu)紙(zhi)及(ji)技術資(zi)(zi)料(liao)的(de)一個重要組成(cheng)部(bu)分。因此,對于(yu)(yu)交(jiao)通(tong)(tong)組織(zhi)(zhi)設(she)(she)(she)計(ji)的(de)主(zhu)管(guan)(guan)(guan)部(bu)門(men)應(ying)當(dang)是(shi)建設(she)(she)(she)行政主(zhu)管(guan)(guan)(guan)部(bu)門(men)。
同(tong)時,大(da)項目施(shi)(shi)工(gong)期間交(jiao)(jiao)通(tong)(tong)(tong)(tong)組(zu)織問(wen)題,應(ying)(ying)當(dang)(dang)主要(yao)解決(jue)施(shi)(shi)工(gong)期間的(de)(de)(de)安(an)(an)全(quan)(quan)(quan)問(wen)題,當(dang)(dang)然也包(bao)括交(jiao)(jiao)通(tong)(tong)(tong)(tong)安(an)(an)全(quan)(quan)(quan)問(wen)題,而不(bu)是城(cheng)市規劃管(guan)理(li)問(wen)題。因此,此時應(ying)(ying)該適(shi)(shi)(shi)用(yong)《安(an)(an)全(quan)(quan)(quan)生產(chan)(chan)法》第(di)二(er)條(tiao)“在中華(hua)(hua)人民(min)共(gong)和(he)國(guo)(guo)領域內從(cong)事(shi)生產(chan)(chan)經(jing)營活(huo)動(dong)的(de)(de)(de)單(dan)位(wei)(以(yi)下統(tong)稱生產(chan)(chan)經(jing)營單(dan)位(wei))的(de)(de)(de)安(an)(an)全(quan)(quan)(quan)生產(chan)(chan),適(shi)(shi)(shi)用(yong)本(ben)法;有關(guan)法律(lv)、行(xing)政法規對消防安(an)(an)全(quan)(quan)(quan)和(he)道(dao)(dao)路(lu)交(jiao)(jiao)通(tong)(tong)(tong)(tong)安(an)(an)全(quan)(quan)(quan)、鐵路(lu)交(jiao)(jiao)通(tong)(tong)(tong)(tong)安(an)(an)全(quan)(quan)(quan)、水上交(jiao)(jiao)通(tong)(tong)(tong)(tong)安(an)(an)全(quan)(quan)(quan)、民(min)用(yong)航空安(an)(an)全(quan)(quan)(quan)另有規定(ding)的(de)(de)(de),適(shi)(shi)(shi)用(yong)其(qi)規定(ding)”;《道(dao)(dao)路(lu)交(jiao)(jiao)通(tong)(tong)(tong)(tong)安(an)(an)全(quan)(quan)(quan)法》第(di)三(san)十(shi)九條(tiao)“公安(an)(an)機關(guan)交(jiao)(jiao)通(tong)(tong)(tong)(tong)管(guan)理(li)部門根據(ju)道(dao)(dao)路(lu)和(he)交(jiao)(jiao)通(tong)(tong)(tong)(tong)流量的(de)(de)(de)具體情況(kuang),可以(yi)對機動(dong)車、非機動(dong)車、行(xing)人采取疏導、限(xian)(xian)制(zhi)通(tong)(tong)(tong)(tong)行(xing)、禁止通(tong)(tong)(tong)(tong)行(xing)等(deng)措施(shi)(shi)。遇有大(da)型群(qun)眾性活(huo)動(dong)、大(da)范圍(wei)施(shi)(shi)工(gong)等(deng)情況(kuang),需要(yao)采取限(xian)(xian)制(zhi)交(jiao)(jiao)通(tong)(tong)(tong)(tong)的(de)(de)(de)措施(shi)(shi),或者(zhe)作出(chu)與公眾的(de)(de)(de)道(dao)(dao)路(lu)交(jiao)(jiao)通(tong)(tong)(tong)(tong)活(huo)動(dong)直接有關(guan)的(de)(de)(de)決(jue)定(ding),應(ying)(ying)當(dang)(dang)提前向社(she)會公告”以(yi)及《建設工(gong)程安(an)(an)全(quan)(quan)(quan)生產(chan)(chan)管(guan)理(li)條(tiao)例(li)》第(di)二(er)條(tiao)“在中華(hua)(hua)人民(min)共(gong)和(he)國(guo)(guo)境內從(cong)事(shi)建設工(gong)程的(de)(de)(de)新建、擴建、改建和(he)拆除等(deng)有關(guan)活(huo)動(dong)及實施(shi)(shi)對建設工(gong)程安(an)(an)全(quan)(quan)(quan)生產(chan)(chan)的(de)(de)(de)監(jian)督管(guan)理(li),必須遵(zun)守本(ben)條(tiao)例(li)”。
因此,本(ben)文認為,大項目(mu)施工期間交通組織(zhi)的(de)交通影(ying)響(xiang)分析,主管部(bu)門(men)應當是公安(an)機(ji)關交通主管部(bu)門(men)與建設行(xing)政主管部(bu)門(men),而(er)不是規劃部(bu)門(men),這樣處理,即(ji)符合慣例,也和現行(xing)的(de)法律相吻合。
