在大陸,北(bei)京是(shi)第(di)一個以規(gui)(gui)(gui)范性文件確立在城(cheng)(cheng)(cheng)市(shi)(shi)(shi)規(gui)(gui)(gui)劃管理中確立交通(tong)(tong)(tong)(tong)影(ying)(ying)響評(ping)價(jia)制(zhi)度(du)(du)(du)的(de)(de)(de)城(cheng)(cheng)(cheng)市(shi)(shi)(shi)。2001年10月,經(jing)北(bei)京市(shi)(shi)(shi)市(shi)(shi)(shi)政府(fu)同意(yi),北(bei)京市(shi)(shi)(shi)規(gui)(gui)(gui)劃委(wei)員會正是(shi)出(chu)臺了《關于對(dui)部分(fen)新建(jian)(jian)項(xiang)目(mu)進(jin)行(xing)(xing)(xing)交通(tong)(tong)(tong)(tong)影(ying)(ying)響評(ping)價(jia)的(de)(de)(de)通(tong)(tong)(tong)(tong)知(zhi)(zhi)》,通(tong)(tong)(tong)(tong)知(zhi)(zhi)實質上宣布(bu)在北(bei)京已經(jing)建(jian)(jian)立了交通(tong)(tong)(tong)(tong)影(ying)(ying)響評(ping)價(jia)制(zhi)度(du)(du)(du),并明(ming)確提(ti)出(chu)“交通(tong)(tong)(tong)(tong)影(ying)(ying)響評(ping)價(jia)及審查論(lun)(lun)證的(de)(de)(de)結論(lun)(lun),是(shi)建(jian)(jian)設(she)(she)(she)項(xiang)目(mu)設(she)(she)(she)計方(fang)案審查的(de)(de)(de)主要(yao)依據之(zhi)一,可參照報告確定的(de)(de)(de)指標,提(ti)出(chu)對(dui)建(jian)(jian)設(she)(she)(she)規(gui)(gui)(gui)模(mo)及土(tu)地(di)開發強度(du)(du)(du)的(de)(de)(de)控制(zhi)要(yao)求,明(ming)確由業(ye)主方(fang)承(cheng)擔的(de)(de)(de)改善(shan)建(jian)(jian)設(she)(she)(she)工程周(zhou)邊交通(tong)(tong)(tong)(tong)環(huan)境的(de)(de)(de)項(xiang)目(mu),必要(yao)時提(ti)出(chu)對(dui)項(xiang)目(mu)停建(jian)(jian)或(huo)緩建(jian)(jian)的(de)(de)(de)意(yi)見”。不僅如此,該《通(tong)(tong)(tong)(tong)知(zhi)(zhi)》還規(gui)(gui)(gui)定凡進(jin)行(xing)(xing)(xing)交通(tong)(tong)(tong)(tong)影(ying)(ying)響評(ping)價(jia)的(de)(de)(de)項(xiang)目(mu)“均需由項(xiang)目(mu)業(ye)主方(fang)委(wei)托(tuo)符合資質的(de)(de)(de)設(she)(she)(she)計或(huo)咨(zi)詢機(ji)構(gou)進(jin)行(xing)(xing)(xing)交通(tong)(tong)(tong)(tong)影(ying)(ying)響評(ping)價(jia)”、“進(jin)行(xing)(xing)(xing)建(jian)(jian)設(she)(she)(she)項(xiang)目(mu)交通(tong)(tong)(tong)(tong)影(ying)(ying)響評(ping)價(jia)咨(zi)詢工作的(de)(de)(de)機(ji)構(gou)應具有(you)城(cheng)(cheng)(cheng)市(shi)(shi)(shi)規(gui)(gui)(gui)劃和(he)交通(tong)(tong)(tong)(tong)咨(zi)詢甲級資質。”
2002年2月,南京市(shi)(shi)規(gui)劃(hua)局(ju)(ju)與公(gong)安交(jiao)通管(guan)理局(ju)(ju)出臺(tai)了《關于“大型(xing)建設(she)項(xiang)目(mu)交(jiao)通影響分(fen)析”規(gui)劃(hua)管(guan)理程(cheng)序的(de)(de)有關規(gui)定(ding)》,在該文(wen)件(jian)中概括地提出了需要進(jin)行交(jiao)通影響分(fen)析的(de)(de)建設(she)項(xiang)目(mu)以及交(jiao)通影響評價管(guan)理程(cheng)序,如規(gui)定(ding)“在南京市(shi)(shi)市(shi)(shi)區范圍內交(jiao)通敏感地段規(gui)劃(hua)選(xuan)址、審(shen)批的(de)(de)大型(xing)公(gong)共(gong)建筑項(xiang)目(mu)應遵(zun)守本規(gui)定(ding)”。
北京、南京的(de)(de)(de)規劃部門(men)在(zai)2001年(nian)、2002年(nian)即在(zai)城(cheng)市(shi)(shi)規劃管理中(zhong)(zhong)確(que)定(ding)了交(jiao)通(tong)(tong)(tong)影響(xiang)評價(jia)制度(du),是非常有(you)(you)(you)遠見的(de)(de)(de),實(shi)踐也證明,這對解決日益(yi)嚴重的(de)(de)(de)城(cheng)市(shi)(shi)交(jiao)通(tong)(tong)(tong)問(wen)題(ti)起到了未雨綢繆的(de)(de)(de)作用,對城(cheng)市(shi)(shi)土地(di)開發與交(jiao)通(tong)(tong)(tong)問(wen)題(ti)的(de)(de)(de)有(you)(you)(you)機結合進行了有(you)(you)(you)益(yi)的(de)(de)(de)探(tan)(tan)索(suo),將城(cheng)市(shi)(shi)交(jiao)通(tong)(tong)(tong)問(wen)題(ti)納(na)入了科學與法(fa)治的(de)(de)(de)軌道。但是,由(you)于兩(liang)個城(cheng)市(shi)(shi)出(chu)臺(tai)的(de)(de)(de)規范性文(wen)件(jian)較早,也沒有(you)(you)(you)其他可以借鑒(jian)的(de)(de)(de)經驗(yan),這兩(liang)個城(cheng)市(shi)(shi)的(de)(de)(de)有(you)(you)(you)些做(zuo)法(fa)難免帶有(you)(you)(you)許(xu)多探(tan)(tan)索(suo)性質。尤其是隨著《行政許(xu)可法(fa)》的(de)(de)(de)實(shi)施,其中(zhong)(zhong)有(you)(you)(you)的(de)(de)(de)地(di)方已經與《行政許(xu)可法(fa)》發生沖突,而有(you)(you)(you)的(de)(de)(de)地(di)方則(ze)留下法(fa)律空白,使得交(jiao)通(tong)(tong)(tong)影響(xiang)評價(jia)制度(du)的(de)(de)(de)實(shi)施,還存在(zai)諸多的(de)(de)(de)法(fa)律障礙。
如北京(jing)市《關于對部分(fen)新建項目(mu)進(jin)行(xing)交(jiao)通(tong)影響評(ping)價(jia)的(de)通(tong)知》規定(ding)“交(jiao)通(tong)影響評(ping)價(jia)及(ji)審查論證的(de)結論,是(shi)(shi)建設項目(mu)設計方案審查的(de)主(zhu)要(yao)依(yi)據之(zhi)一,可(ke)參照報告確定(ding)的(de)指(zhi)標(biao),提出(chu)對建設規模及(ji)土地(di)開(kai)發強(qiang)度的(de)控(kong)制要(yao)求,明確由業主(zhu)方承(cheng)擔的(de)改善建設工程周邊交(jiao)通(tong)環境的(de)項目(mu),必要(yao)時提出(chu)對項目(mu)停建或緩建的(de)意見”。根(gen)據《行(xing)政(zheng)許可(ke)法》第(di)二(er)條的(de)規定(ding)“本法所稱行(xing)政(zheng)許可(ke),是(shi)(shi)指(zhi)行(xing)政(zheng)機關根(gen)據公民、法人或者其(qi)(qi)他組織的(de)申(shen)請,經依(yi)法審查,準予其(qi)(qi)從事特定(ding)活動的(de)行(xing)為。”因此,在城市規劃管理中建立交(jiao)通(tong)影響評(ping)價(jia)制度,實質上就是(shi)(shi)是(shi)(shi)否允許某項項目(mu)進(jin)行(xing)建設,即一項行(xing)政(zheng)許可(ke),其(qi)(qi)法律地(di)位相(xiang)當(dang)于“一書兩證”。
但是,“一書兩證(zheng)”制度的建立,在(zai)《城(cheng)市規(gui)(gui)(gui)(gui)劃(hua)法》第三(san)十(shi)、三(san)十(shi)一、三(san)十(shi)二條(tiao)(tiao)中是有著(zhu)明確的規(gui)(gui)(gui)(gui)定(ding)(ding)的。而(er)根(gen)據《行(xing)(xing)政(zheng)許(xu)可法》第十(shi)七條(tiao)(tiao)的規(gui)(gui)(gui)(gui)定(ding)(ding)“除本法第十(shi)四條(tiao)(tiao)、第十(shi)五條(tiao)(tiao)規(gui)(gui)(gui)(gui)定(ding)(ding)的外,其他規(gui)(gui)(gui)(gui)范性文件(jian)一律(lv)不得設定(ding)(ding)行(xing)(xing)政(zheng)許(xu)可。” 北京、南京的規(gui)(gui)(gui)(gui)劃(hua)部(bu)門的規(gui)(gui)(gui)(gui)范性文件(jian),卻屬(shu)于《行(xing)(xing)政(zheng)許(xu)可法》第十(shi)七條(tiao)(tiao)規(gui)(gui)(gui)(gui)定(ding)(ding)的“其他規(gui)(gui)(gui)(gui)范性文件(jian)”,因此(ci),規(gui)(gui)(gui)(gui)劃(hua)部(bu)門的文件(jian)法律(lv)效力太低,如果以它們為依據,是不能(neng)設定(ding)(ding)交通影響評價制度的。
2004年5月(yue)1日(ri)開始實施的《中(zhong)華人(ren)民共和國道路交(jiao)通(tong)安全法實施條(tiao)例》第三條(tiao)規(gui)定(ding)“縣級以上地方各級人(ren)民政(zheng)府應(ying)當建立、健全道路交(jiao)通(tong)安全工作協調機制(zhi),組織有關部門對(dui)城(cheng)市建設(she)項(xiang)目(mu)進(jin)行(xing)交(jiao)通(tong)影響評價(jia),制(zhi)定(ding)道路交(jiao)通(tong)安全管理規(gui)劃,確定(ding)管理目(mu)標,制(zhi)定(ding)實施方案。”。根據《行(xing)政(zheng)許可(ke)法》第十二(er)條(tiao)的規(gui)定(ding)“下列事(shi)項(xiang)可(ke)以設(she)定(ding)行(xing)政(zheng)許可(ke):(六)法律、行(xing)政(zheng)法規(gui)規(gui)定(ding)可(ke)以設(she)定(ding)行(xing)政(zheng)許可(ke)的其他事(shi)項(xiang)”。
由于《道(dao)(dao)路交(jiao)(jiao)(jiao)通(tong)(tong)(tong)安(an)全(quan)法(fa)(fa)(fa)實(shi)(shi)施條(tiao)例(li)》作為行(xing)(xing)政法(fa)(fa)(fa)規,是可(ke)以設定行(xing)(xing)政許可(ke)的(de)(de)。因此(ci),隨著《道(dao)(dao)路交(jiao)(jiao)(jiao)通(tong)(tong)(tong)安(an)全(quan)法(fa)(fa)(fa)實(shi)(shi)施條(tiao)例(li)》的(de)(de)實(shi)(shi)施,城市規劃管(guan)理程序中的(de)(de)交(jiao)(jiao)(jiao)通(tong)(tong)(tong)影響(xiang)評價(jia)制(zhi)度有(you)了法(fa)(fa)(fa)律(lv)依據(ju)。相應地,北京、南京以及其(qi)它正試(shi)圖建(jian)立交(jiao)(jiao)(jiao)通(tong)(tong)(tong)影響(xiang)評價(jia)制(zhi)度的(de)(de)城市,必須以《道(dao)(dao)路交(jiao)(jiao)(jiao)通(tong)(tong)(tong)安(an)全(quan)法(fa)(fa)(fa)實(shi)(shi)施條(tiao)例(li)》為建(jian)立交(jiao)(jiao)(jiao)通(tong)(tong)(tong)影響(xiang)評價(jia)制(zhi)度的(de)(de)最高法(fa)(fa)(fa)律(lv),所頒布的(de)(de)所有(you)文(wen)件均不得與(yu)其(qi)沖(chong)突,并應當依據(ju)《道(dao)(dao)路交(jiao)(jiao)(jiao)通(tong)(tong)(tong)安(an)全(quan)法(fa)(fa)(fa)實(shi)(shi)施條(tiao)例(li)》對(dui)其(qi)已(yi)經頒布的(de)(de)文(wen)件進行(xing)(xing)自查(cha),凡與(yu)《道(dao)(dao)路交(jiao)(jiao)(jiao)通(tong)(tong)(tong)安(an)全(quan)法(fa)(fa)(fa)實(shi)(shi)施條(tiao)例(li)》發生(sheng)沖(chong)突的(de)(de),都應當予以修改(gai)。
由(you)于(yu)《條例》規定“縣級以上地(di)方(fang)各級人(ren)民政(zheng)府(fu)應當……組織(zhi)有(you)關部門對城(cheng)市(shi)建設(she)項(xiang)目(mu)進行交(jiao)通影響(xiang)(xiang)評(ping)價”,因此,城(cheng)市(shi)規劃管理中的(de)交(jiao)通影響(xiang)(xiang)評(ping)價制(zhi)度不僅已經建立了起來,而且是(shi)縣級以上地(di)方(fang)各級人(ren)民政(zheng)府(fu)的(de)法(fa)定義務,并應當獲得與“一書兩(liang)證(zheng)”同等(deng)的(de)法(fa)律地(di)位。
遺憾的(de)(de)(de)(de)(de)是(shi),由于(yu)(yu)《道路交(jiao)通(tong)(tong)安全(quan)法實施條例》對(dui)交(jiao)通(tong)(tong)影響評(ping)(ping)價制(zhi)(zhi)度(du)(du)規(gui)定的(de)(de)(de)(de)(de)太原則,不僅沒有(you)規(gui)定交(jiao)通(tong)(tong)影響評(ping)(ping)價制(zhi)(zhi)度(du)(du)與城市(shi)規(gui)劃管理(li)的(de)(de)(de)(de)(de)銜接問題(ti)、編制(zhi)(zhi)問題(ti),甚至連交(jiao)通(tong)(tong)影響評(ping)(ping)價制(zhi)(zhi)度(du)(du)的(de)(de)(de)(de)(de)主管部門這(zhe)個首要(yao)的(de)(de)(de)(de)(de)問題(ti)都沒有(you)確(que)定,因(yin)此(ci),交(jiao)通(tong)(tong)影響評(ping)(ping)價制(zhi)(zhi)度(du)(du)要(yao)想真正(zheng)(zheng)獲得與“一書兩(liang)證”同(tong)等(deng)的(de)(de)(de)(de)(de)法律地(di)位,并得到同(tong)等(deng)的(de)(de)(de)(de)(de)重(zhong)視,還需要(yao)相(xiang)關(guan)具體實施辦法予以配套。這(zhe)也是(shi)目(mu)前全(quan)國城市(shi)規(gui)劃管理(li)部門并沒有(you)因(yin)為《道路交(jiao)通(tong)(tong)安全(quan)法實施條例》的(de)(de)(de)(de)(de)實施,而正(zheng)(zheng)式確(que)立交(jiao)通(tong)(tong)影響評(ping)(ping)價制(zhi)(zhi)度(du)(du)的(de)(de)(de)(de)(de)原因(yin)。本文認為,如果相(xiang)關(guan)的(de)(de)(de)(de)(de)法律問題(ti)不予解(jie)決,《條例》中極富遠(yuan)見的(de)(de)(de)(de)(de)建立“交(jiao)通(tong)(tong)影響評(ping)(ping)價制(zhi)(zhi)度(du)(du)”規(gui)定,將長期(qi)處于(yu)(yu)“休眠狀(zhuang)態”。
